Once the police have sufficient evidence linking an individual to a crime, the investigation may go to court depending on how serious the crime is. Every suspect needs a solicitor or multiple, this is the defence within the court. There is two sides within the court, the prosecution and the defence. The defence's aim is to avoid any criminal liablility where as the prosecution is the other way around. Both sides will state their arguments basing them upon evidence, fact and witness accounts. Both arguments will be opposed to eachother as both sides aims are the opposite to one another. The main responsibility for the Defence team is to have their client found innocent or aquitted from the trial.
The Defence Team within the OJ Simpson Case...
The
Defence team within the case of OJ Simpson was profoundly known as the ‘Dream
team’ as labelled by the media. The team included two highly commendable
lawyers Robert Kardashian and Johnnie Cochran. However there were several more lawyers which OJ had appointment for his defence F. Lee Bailey, Johnnie Cochran. Alan Dershowitz, Carl Douglas, Robert Kardashian, Peter Neufeld, Barry Scheck and Robert Shapiro.
Cochran played the more Dominant
role between the lawyers and argued with the prosecution when appropriate. The
most memorable moment within this court case was the statement from Cochran ‘If
it does not fit you must acquit’ his
quote was made surrounding the glove. Within court OJ was made to put the glove
found within the illegal search of his property made by Fuhrman to prove that
it did not fit by his defence lawyers. When it showed to not fit this statement
was made and the glove was no longer admissible within the court case. The
defences responsibility and role was to have their client found innocent by the
jury or have them acquitted from the investigation, their role was achieved
after a long 137 when OJ Simpson was acquitted from the case. This was due to
how poor the police officers and scenes of crime officers collected, preserved
and examined the evidence allowing for most of the evidence to not be admissible
within court.

The defence team in other cases…
Depending
upon an individual’s situation they may not be able to afford a solicitor to
represent them within court therefore opt for legal aid. Legal aid will then
decide whether that individual is eligible and meets all the criteria for legal
aid. If so the defendant will be appointed a solicitor provided by the
government funded by the working people’s taxes. This works the same within America
and even states it when read their Miranda Rights ‘you have the right to an
attorney. If you cannot afford an attorney one will be appointed for you” these
attorneys will also be funded by the American working people’s taxes. However
if a defendant can afford their own attorney they get to pick their defence.
The roles and responsibilities of the defence team in any case is the same, to
defend their client and prioritise them leaving court being found innocent or
being acquitted from trial.
